1. What You’re Downloading

The software (the “Distribution”) is a Linux Distribution for a number of network switches. We compile, integrate, and test multiple open source components into binary images.

Our service is the compilation and distribution – not the software licensing. Each component remains under its original open source license. We do not endorse or market the switching hardware.

2. Licenses

2.1 Open Source Components

The Distribution contains software primarily licensed under:

GNU General Public License v2.0 (GPLv2) – majority of components
Other licenses: GPLv3, LGPL, Apache 2.0, BSD, MIT, MPL, and others

Your rights and obligations are defined by each component’s license, not by us.

2.3 Source Code Availability (GPL Compliance)

Source code for GPL and other copyleft components is available at http://repo.bisdn.de/pub/onie/generic-x86-64/ or by written request. This offer is valid for three (3) years from distribution date.

2.4 Components shipped as binary only

The Distribution includes OF-DPA (OpenFlow Data Plane Abstraction) by Broadcom Inc., which is NOT open source and is shipped as pre-compiled binary. Additionally it contains appropriate firmware files for Broadcom Trident 3 switches.

You shall not use, license, sell or otherwise distribute the Software or any Derivative Work except as provided in this Agreement, and shall not attempt to, except as legally permissible, reverse engineer, decompile or disassemble any portion of the Object Code or work around any technical limitation in the Software.

3. What We Did

We have compiled the binary images exercising reasonable care:

Selected compatible license components
Built from source to the best of our knowledge and ability
Conducted functional testing and security scanning
Verified OF-DPA authenticity and tested integration (BISDN does not have the right to publish the source code)

We aim to provide images free from third-party rights conflicts and harmful effects.

4. NO WARRANTY and Liability for Defects (Gewährleistung und Mängelhaftung)

4.1. Free of Charge: The Distribution is provided to you free of charge. 4.2. Defects of Quality (Sachmängel): We provide the Distribution “AS IS” and disclaim all warranties including merchantability, fitness for purpose, security, accuracy, or absence of defects. We shall only be liable for defects of quality if we fraudulently concealed the defect (Arglist). 4.3. Defects of Title (Rechtsmängel): We shall only be liable for defects of title (e.g., third-party IP rights infringement) if we were grossly negligent or acted with willful intent, or if we fraudulently concealed the defect. 4.4. OF-DPA Specific: We make NO warranty regarding functionality, security, compatibility, or absence of defects specifically concerning the OF-DPA component. You are solely responsible for verifying and testing the product.

5. LIMITATION OF LIABILITY (Haftungsbeschränkung)

5.1. Full Liability (Unbegrenzte Haftung): We shall have unlimited liability for damages resulting from: * Willful misconduct (Vorsatz) or gross negligence (Grobe Fahrlässigkeit). * Injury to life, limb, or health (Verletzung von Leben, Körper oder Gesundheit). * Liability under the German Product Liability Act (Produkthaftungsgesetz). * Fraudulent concealment of a defect.

5.2. Breach of Essential Contractual Obligations (Kardinalpflichten): In case of a breach of an essential contractual obligation (a duty whose proper fulfillment is a condition sine qua non for the achievement of the purpose of the contract, and on the fulfillment of which the user may rely), our liability shall be limited to the foreseeable damage typical for the contract. The liability for loss of data shall be limited to the typical recovery effort that would have been necessary if you had regularly and appropriately backed up data.

5.3. General Liability Exclusion (Sonstige Haftung): Subject to Sections 5.1 and 5.2, we exclude all other liability for any damages (direct, indirect, consequential, or other damages) arising from the use or inability to use the Distribution, errors, bugs, or security vulnerabilities.

6. Indemnification

You indemnify and hold us harmless from any claims arising from:

Your use or distribution of the Distribution.
Your violation of component licenses or these Terms.
Third-party claims related to your use, including claims arising from your non-compliance with the OF-DPA license terms.

7. Trademarks

“BISDN Linux” is our trademark. You may not use it when distributing the software without permission, except for accurate attribution. Remove our trademarks if distributing modified versions. “OF-DPA” is a Broadcom trademark.

8. Export Control

You agree to comply with all export control laws. The Distribution contains encryption software. You’re responsible for obtaining necessary approvals and complying with restrictions.

9. Data Processing (GDPR)

We collect: Name, email, download timestamp, IP address, version downloaded.

Purpose: Security notifications, statistics.
Legal Basis (DSGVO): Performance of contract or legitimate interests (Art. 6(1)(b) or (f) GDPR).
Your Rights: Access, rectify, erase, restrict, object (GDPR).

10. Cyber Resilience Act (CRA) Compliance and Security Commitments

10.1. Vulnerability Handling Policy: As the manufacturer of a Product with Digital Elements (PWE), we maintain a Vulnerability Handling Policy. We undertake to: * Monitor, document, and promptly address vulnerabilities reported by users or third parties. * Maintain a dedicated security contact point for vulnerability reports: [security email or URL]. * Provide essential information concerning actively exploited vulnerabilities to the relevant national Computer Security Incident Response Team (CSIRT) or ENISA, as required by the CRA, once applicable.

10.2. Support Period: We commit to providing security updates and vulnerability patches for the core components of the Distribution for a period of [Minimum Support Duration, e.g., three (3) years] from the date of download, provided you use the designated software version.

10.3. Compliance: We commit to ensuring that the Distribution, when placed on the market, complies with the essential cybersecurity requirements set out in the CRA, to the extent that it is categorized as a PWE under that Regulation.

11. Redistribution Requirements

If you distribute the Distribution or modifications:

GPL components require: Include source code or written offer for source; Preserve copyright and license notices; License modifications under GPL where required.
OF-DPA requires: Include Broadcom’s license; May need separate Broadcom authorization.
Modifications: Clearly mark all changes; Don’t claim our endorsement; Consider using a different name.

12. General Terms

Governing Law: German law (excluding CISG).
Jurisdiction: Berlin, Germany.
Changes: We may update these Terms anytime; the version valid at the time of download applies.
Your licenses: Continue under component licenses regardless of these Terms.
Entire Agreement: These Terms + component licenses + OF-DPA license.
Language: The English version controls.
